1. Who we are
NAU Kart Components (“NAU”, “we”) operates this website as an online marketplace where members of the public and businesses can list, sell, bid on and buy karting equipment, and as a retail shop for new products sold by us directly. 2. Our role in marketplace sales
For marketplace listings, the contract of sale is between the buyer and the seller. We are not the seller and do not own the items. We provide the platform, payment processing (via Stripe), payment protection, and dispute assistance. Items sold in the NAU shop are sold by us directly and separate shop terms apply.
3. Accounts
- You must be 18 or over and provide accurate information.
- Sellers must complete identity and bank verification (operated by Stripe) before listing.
- Sellers must accurately declare whether they sell as a private individual or as a business. Business sellers are labelled as such and consumer law applies to their sales. We may reclassify accounts that show a pattern of trading.
- We may suspend accounts that breach these terms, attempt fraud, manipulate bids or take sales off-platform.
4. Listings and auctions
- Listings must be accurate, describe faults honestly, use your own photos of the actual item, and be placed in a sensible category. Prohibited items may not be listed.
- A bid is a binding commitment to buy at that price. Sellers must not bid on their own items directly or indirectly.
- Bids placed in the final minutes extend the auction (anti-sniping). Reserve prices are permitted and hidden from bidders.
- Auction winners must pay within 3 days. Repeated non-payment leads to account restrictions.
5. Payments, fees and payouts
- All payments must be made through the platform. Arranging payment outside the platform is prohibited, removes all protection, and may lead to suspension.
- Buyers' payments are held by our payment provider and released to the seller after delivery or collection is confirmed, or automatically 7 days after dispatch if no problem is reported. Opening a dispute pauses release.
- Our selling fee is 10% of the total sale amount (item plus postage), deducted automatically before payout. See Fees.
- Sellers must dispatch within 7 days of payment (or make the item available for collection), and use tracked postage for items over £100.
6. Cancellations, returns and disputes
- Business sellers: consumers have a 14-day cancellation right after delivery under the Consumer Contracts Regulations 2013 (exceptions apply, e.g. personalised goods), plus rights under the Consumer Rights Act 2015.
- Private sellers: statutory cancellation rights do not apply, but items must match their description.
- Problems must be reported through the dispute process before the payment release date. We may decide disputes on the evidence available and issue refunds from held funds, or recover funds from sellers where a dispute succeeds after payout.
7. Tax and reporting
Sellers are responsible for their own tax affairs. As a UK digital platform we are required to collect seller information and report certain seller data annually to HMRC under the Reporting Rules for Digital Platforms once sellers exceed the reporting thresholds.
8. Liability
We do not exclude liability where it would be unlawful to do so. As a marketplace we are not responsible for the quality, safety or legality of items listed by sellers, though we operate the protections described above. Motorsport equipment is used at your own risk; buyers should verify the suitability and safety of used equipment (including helmets and safety wear) before use.
9. Changes
We may update these terms; material changes will be notified to account holders. Continued use after changes take effect constitutes acceptance.
